This document contains the Terms and Conditions that apply to a becoming a participant in the
Nature's Wonderland Affiliate program.

 

 

This Affiliate Service Agreement (the "Agreement") is made by and between Nature's Wonderland, a Qld, AUSTRALIA business ("NaturesWonderland.biz"), and you, as an Affiliate user of the Nature's Wonderland service ("You", "Your", "Affiliate"). 

To be an authorised Affiliate of Nature's Wonderland, You agree to abide by the Terms and Conditions contained in this Agreement. Please read this Agreement carefully before registering and using the Nature's Wonderland Service as an Affiliate. By signing up for Nature's Wonderland, you indicate Your acceptance of this Agreement and its Terms and Conditions. If You do not accept this Agreement, you may not use the Nature's Wonderland Service as an Affiliate.

You may enrol in the program online by filling in and submitting the AFFILIATE APPLICATION FORM.  You will be issued with an Affiliate Kit and ID of your choice, however we reserve the right to terminate your membership if we determine, at our sole discretion, that your site is unsuitable for the program.  Unsuitable sites include, but are not limited to, for example, sites that:

  • promote sexually explicit materials 

  • promote violence 

  • promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age 

  • promote illegal activities or violate intellectual property rights 

  • from applicants with whom we prefer not to be associated

We grant you a non-exclusive, revocable right to use our present Banners and other such Images for which we grant express permission, for the purpose of identifying your site as a program participant and linking to our site.  You may not modify the Banners or any of our Images in any way without our express permission. 
We reserve all of our rights to our trade names and trademarks and all other intellectual property rights. 

 

PRIVACY POLICY

Nature's Wonderland respects the privacy of its users and promises not to disclose personal or business information to third parties without the express permission of You and Your company. We will not sell Your name, e-mail address, phone number, or any other personal information to anyone else. We consider this information to be private, and it will remain as such. If You have any questions about Your privacy rights, contact us at Affiliate@NaturesWonderland.biz 

The following agreement is summarised as follows:

  • You place our Affiliate Banners anywhere on your site as you see fit, or within non-spam emails.

  • We may email you concerning relevant information

  • We might change the service if we feel it necessary

  • Adult, Hate, or other related sites are not allowed

  • You will be paid your commissions, weekly or monthly, dependant upon your account balance reaching $50 or more.

  • All statistics are collected and calculated by Nature's Wonderland, and will be the only valid stats used for determining commissions.

  • Any page that contains Nature's Wonderland links, banners, or code must be written in English.

  • As an Affiliate, you can only have 1 account. You may list multiple domains in one account, but only one account is allowed. Self-referrals for Affiliate accounts are strictly prohibited.

  • International Affiliates (those with addresses outside Australia) are paid ONLY via PayPal and Australian residents will be paid via Your choice of Direct Deposit or PayPal.

  • Your physical address listed for receiving information and material MUST be your actual address. Mail forwarding services, for the purpose of avoiding network demographics, is NOT allowed. For example, if you choose USA as your country, you must be in the USA. If you choose Russia as a country, you must be in Russia - and so on.

  • You won't hold us liable for anything on your site.  A link to a non-Nature's Wonderland Web site does not mean that Nature's Wonderland endorses or accepts any responsibility for the content or the use of such Web site.

  • You cannot SPAM. You cannot SPAM. You cannot SPAM. We will terminate your account on the first offence of SPAMMING. Do not send email to lists or groups to which you do not have permission to send. We cannot stress this enough, we WILL terminate your account on the first offence.

  • You may place Banners or Links within your newsletters, in the content of your website, or within other web related content.

  • Affiliate accounts that are left inactive will be removed from our system if their balance is equal to or less than $25. If an abandoned Affiliate account has a balance between $25 and $50, a $25 fee will be assessed once per calendar month, until the balance is equal to zero dollars - and is closed. At no time will an Affiliate ever owe monies to Nature's Wonderland based on fees - the account will simply be closed. An abandoned Affiliate account is defined as any account that has not been active for a period of 6 months, nor have any transactions been posted to that account. If one or the other of those conditions are true - the account 

  • Failure to abide by these rules could mean termination from Nature's Wonderland completely with a complete forfeit of commissions.

  • Fraud is a serious offence, and will be treated as such. Fraud is defined as any action that intentionally attempts to create sales or leads for the sole purpose of creating commissions. ANY ATTEMPTED FRAUD OR FRAUD WILL RESULT IN MEMBERSHIP TERMINATION AND VOIDED COMMISSIONS.

  • You cannot refer yourself as a Merchant with Nature's Wonderland and receive commission. Sorry.

Unsolicited email (SPAM) 
We will not tolerate the sending of unsolicited bulk emails that promote, or make reference to Nature's Wonderland, or any of its associated companies, partners, or employees. Other prohibited forms of advertising include postings to non-commercial newsgroups and cross-posting to multiple newsgroups at once. In addition, Affiliates may not advertise in any way that effectively conceals or misrepresents their identity, their domain name or their return email address. 
Any Affiliate who, in our opinion, breaches this ruling will have their Affiliate status cancelled immediately and any and all outstanding commissions WILL BE FORFEITED. 
  
Stay Safe, Don't SPAM. 
  
We will NOT revoke Affiliate status to avoid payment of owed or future commissions. 
  
Unprofessional Conduct 
Nature's Wonderland operates with strict codes of professional conduct. Any Affiliate who brings Nature's Wonderland or its associates into disrepute, or who promotes any form of slander or unfair business practices, will have their Affiliate status cancelled and any outstanding commissions will be forfeited. We reserve the right to reject any Affiliate Application if, in our opinion, that person or company violates established laws or commonly held standards of decency. 
An Affiliate who ignores warnings to cease and desist any activities we deem negligent, inappropriate, or harmful to Nature's Wonderland and/or other Affiliates, will be terminated. 
  
Order Processing 
We will be solely responsible for processing every order for our products. Customers will use our secure online ordering process through our store. Order forms, payment processing, shipping, cancellations, returns, and related customer service are our responsibility. 
All of our rules, operating procedures and policies regarding customer orders and accounts will apply to orders we receive through special links on your site. We reserve the right to reject any order that does not comply with our rules, operating procedures and policies. 
Every customer who buys our products through this program is deemed to be a customer of ours. Affiliates do not have the authority to make or accept any offer on our behalf. All our policies regarding customer orders, pricing and problem resolution will apply to these customers. We are not responsible for any representations made by you that contradict our policies. 
You may order our products and services for your own personal use through your Affiliate link. 
  
Sales Tracking 
We will be solely responsible for tracking sales we make to customers who follow links from your website. Reports of your sales activity in the Nature's Wonderland affiliate program will be available to you on request.  The only entities that have access to your statistics and Affiliate information are you, and us (Nature's Wonderland). 
  
Links 
We will provide you with a unique identifying Affiliate Name - of your choice. Each sale or referral that is generated from this ID will be attributed to you. Your links using your ID can be text links or image links, or a combination of the two, at your sole discretion. If you choose image links, you must use our images. We will supply the images to you upon acceptance of your application. You may add as many links to Nature's Wonderland, or remove such links, at anytime and without prior approval from us. 
Inactive Affiliates may be removed from participation in the program. Inactive means little or no "click-throughs" via your unique Affiliate ID for a period of sixty (60) days (as monitored by us), and/or non-placement of Affiliate image/text ads. We may contact you after thirty (30) days of inactivity. Efforts may be made to help and encourage your participation in the program. 
We will provide you with instructions on how to properly format the links. You are responsible for ensuring the links are formatted correctly. This will ensure accurate tracking of sales for credit to your account. Every effort will be made to ensure that our site is functional and available for customers referred to our site through your Affiliate link. 
We have NO responsibilities with regard to your site. Nature's Wonderland shall have no liability for any indirect, incidental, special or consequential damages, or any loss of revenue or profits arising under, or with respect to, this agreement or the program. In addition, Nature's Wonderland aggregate liability arising under, or with respect to, this agreement or the program, shall in no event exceed total referral fees paid or payable to the Affiliate under this agreement. 
  
Payment of Commissions 
We will pay you 10% of the total purchase (with the exception of some products of our Portfolio that are given a different commission rate, as specified when you join) made by a customer referred by your "Affiliate ID" through our Banners or text links (Not including shipping charge). We are not responsible for paying interest to Affiliates for accrued, but not yet delivered, commission payments.
Any payments will be made to you after a minimum of 15 days after the purchase, to ensure no refund is due, and once your account reaches over a balance of AU$50. 
All payments will be in Australian dollars only. 
  
Term of the Agreement 
The term of this agreement will begin upon our acceptance of your Affiliate Program Application and your placement of our Banner or textual link on your site, and will end when terminated by either party. Either party may terminate this agreement at any time, by giving the other party written notice of termination. This will be in the form of "email". You can only earn referral fees on sales occurring during the term. We will never withhold any payment due. Payment of monies owed you will be payable on the same schedule as stated above for commission payment. Upon termination of this agreement, the former Affiliate must remove all Affiliate links and graphics from their web site, and refrain from publishing these in any manner whatsoever. 
  
Modification 
We may modify any of the Terms and Conditions contained within this agreement, at any time and at our sole discretion, by posting a new agreement on our site. Any modifications will also be notified, by email, to all participating Affiliates. If any modification is unacceptable to you, you may terminate this agreement. Your continued participation in the program, following notification of any new aspects to the program, will constitute binding acceptance of the change. 
  
Privacy Policy 
Information you submit for the purposes of this Affiliate program will be used only for Affiliate membership purposes (to make your commission payments and to communicate changes in our product offerings.) We will not email you with any other company's products. We will notify you of new Banners and/or text links to facilitate promotion of Nature's Wonderland. We do not now, nor will we in the future, sell, rent or otherwise make your personal information available to any third party/parties. 

This concludes the agreement. Thank you for taking the time to read through it carefully. We look forward to sharing time together and to working alongside you.

By filling in and submitting the AFFILIATE APPLICATION FORM to sign-up to our program, you are agreeing to the above Terms and Conditions.
